Why is our attorney smiling? Well, usually no one ever reads this stuff. But you, being the conscientious and careful person that you are, have taken the time to look over her hard work. She hopes you like it.

By subscribing to the services of Communications Unlimited Inc. (“CommsUnlimited”), you agree to the following terms and conditions with respect to your account. Use of CommsUnlimited services constitutes your consent to these terms and conditions.

Disclaimers and Limitation of Liability

CommsUnlimited does not guarantee the continuous, uninterrupted or secure access to its website or any related services. Under no circumstances shall CommsUnlimited be liable for damages resulting from the use of, or inability to use, CommsUnlimited services or website content.

Fraudulent Activities

CommsUnlimited reserves the right to deactivate, disable, or remove any suspicious or fraudulent account with or without notice. You are responsible for maintaining accurate account information and preventing unauthorized use of your account and payment credentials.

Promotion, Coupon Code

Each promotion is identified by a unique coupon code and has separate requirements and rewards as stated in the offer. Coupon codes are valid only for eligible online orders and may not be combined with other promotions.

Features

CommsUnlimited reserves the right to create, modify, or discontinue features with or without notice and is not responsible for lost, stolen, or unauthorized use of your account.

Ownership of Numbers

All numbers assigned by CommsUnlimited, including U.S., Canada, international, and toll-free numbers, remain the property of CommsUnlimited. Transfer of ownership or services requires express consent, and approved number transfer requests may be subject to a transfer-service charge.

Fair Use Policy

CommsUnlimited operates a Fair Use Policy to prevent excessive, inappropriate, or unreasonable use from affecting service quality for other customers. Continued abusive use may result in suspension or removal of service.

Cancellation

This agreement remains in effect until cancelled by either party. To cancel, written notice must be sent to Communications Unlimited Inc., Customer Service, 149 SW 57th Avenue, Miami, Florida 33144, USA, and must include your CommsUnlimited PIN and current mailing address.

Billing

A subscription to CommsUnlimited requires a credit card for payment. By providing a card number, you authorize CommsUnlimited to submit charges. Refunds, when applicable, are returned to the original payment method on file.

No Emergency Services

You expressly agree and understand that CommsUnlimited is not intended to support or carry emergency calls to hospitals, law enforcement agencies, medical care units, or other emergency services.

Softphone, Smartphone App and Other VoIP Registration Media

To receive the benefits provided by the CommsUnlimited Softphone or App, you grant permission for limited use of your computer or smartphone processor and bandwidth to access the network. Technical support is provided only for CommsUnlimited-labeled software and hardware.

Public Phone and Operator Services Surcharge

Calls placed using public pay phones, hotel phones, dormitory phones, or commercial phone line systems may be subject to a surcharge, billed to the applicable CommsUnlimited account.

Customer Support

Customer Support is intended solely for issues related to CommsUnlimited accounts. Misuse of support services may result in restricted access, blocked future access, or additional remedies as appropriate.

Changes to Terms and Conditions

CommsUnlimited reserves the right to revise these Terms and Conditions at any time, and users are deemed to be apprised of and bound by any changes. Prices on this page are subject to change without notice.

SERVICE LEVEL AGREEMENT

Metro-Ethernet and Dedicated Internet Access Services

1. Technical Specifications

Metro-Ethernet Service shall be IEEE 802.3 and MEF 6.1 compliant. Layer 2 telecommunications transport links are provided between two or more designated demarcation points to support Metro-Ethernet and Dedicated Internet Access services.

2. Service Outage

A Service Outage is a complete disruption of an On-Net Metro-Ethernet or DIA service such that the customer is unable to use the service for its intended purpose. The outage begins upon provider receipt of notice and ends when service is operational per provider records.

3. Performance Objectives

Service Availability: 99.9% or greater per month
Latency: 30ms round trip
Packet Loss: Less than 0.1%
Jitter: Less than 10ms

4. Service Restoration Objectives

Mean Time to Respond: 2 hours from notice of outage.
Mean Time to Repair: 4 hours from the moment provider is given access to all necessary service components.

5. Service Credits

In the event of a Service Outage, the customer may request a Service Credit based on the applicable monthly recurring charge and outage duration.

More than 16 Hours to 20 Hours	30% of Applicable MRC
More than 20 Hours	40% of Applicable MRC

Provider's total liability for all interruptions shall not exceed 50% of the MRC for the affected service. Customer must be in good standing to be eligible for Service Credits.

6. Service Credit Request

Customer must submit a written request no later than 30 days following the event. Failure to request within that period constitutes a waiver of any claim for a Service Credit.

7. Multiple Applicable Service Standards

If an incident entitles a customer to credits under multiple service standards, only the single highest credit applies. Credits may not be stacked for the same incident.

8. Events Excepted From Service Credit

No Service Credit will be issued for outages arising from the following:

Customer negligence, intentional act, or failure to cooperate with provider
Failure of customer equipment or vendor equipment
Failure of electrical power not provided by provider
Trouble caused by services or systems not provided by provider
Scheduled or emergency maintenance
Force Majeure events
Disconnection or suspension by provider pursuant to agreement rights

Data & Security

Privacy & Security Policy

Communications Unlimited Inc.

By subscribing to Communications Unlimited Inc. Internet Services, each commercial customer agrees not to use the service for any unlawful purpose and to comply with the company’s Acceptable Use Policy. The policy may be updated from time to time, and revised versions become effective upon posting.

Multiple Users

The Internet Service and related equipment provided by Communications Unlimited Inc. are intended only for the customer and authorized users. The customer remains responsible for ensuring that all employees, agents, guests, and other users understand and comply with the Acceptable Use Policy.

Security Responsibilities

Customers are responsible for any misuse of the Internet Service, even if the misuse is committed by another user. Customers must protect passwords, restrict unauthorized access, and secure any connected device and stored data. Communications Unlimited Inc. recommends disabling unnecessary file or printer sharing and protecting remotely accessible files and services with strong passwords.

Unlawful Use and Prohibited Activities

Use of the Internet Service for activity that violates local, state, federal, or international law is prohibited. Examples include, but are not limited to:

Posting or disseminating unlawful material
Copyright or intellectual property infringement
Fraudulent schemes, impersonation, or forged signatures
Privacy invasion, hacking, or unauthorized access attempts
Spam, junk mail, or abusive bulk distribution activity
Transmission of harmful, threatening, abusive, obscene, or otherwise objectionable material

Monitoring and Enforcement

Communications Unlimited Inc. does not routinely monitor customer activity for policy violations, but reserves the right to monitor bandwidth, usage, transmissions, and content as reasonably necessary to operate the service, protect the network, identify violations, and protect users. If the service is used in a manner believed to violate policy, the company may suspend or terminate service, remove content, filter transmissions, investigate the matter, and cooperate with law enforcement or other system administrators as appropriate.

Account Information and Cooperation

During an investigation, Communications Unlimited Inc. may gather information from the customer, other users, and complaining parties, and may provide account information such as usernames, customer name, IP address, and related account details to law enforcement or system administrators when appropriate to enforce policy or investigate suspected legal violations.

Fair Usage Allowance

Residential and business voice services may be subject to usage limits. Communications Unlimited Inc. reserves the right to suspend, terminate, re-rate, or surcharge services that exceed fair usage thresholds. Long-duration calls may also be disconnected as a fraud and security measure.

Policy Updates and Customer Responsibility

Customers are expected to review policy updates periodically and remain in compliance at all times. Failure to comply may result in suspension, termination, investigation, cost recovery, or other legal and technical action deemed appropriate by Communications Unlimited Inc.

We do not sell personal information in the ordinary course of business. We may disclose information to service providers, payment processors, contractors, legal advisors, regulators, law enforcement, or other parties when reasonably necessary to operate our business, enforce agreements, investigate misuse, comply with law, or protect rights, property, and safety.

Customer Choices and Requests

Customers may contact Communications Unlimited Inc. to update account information, request correction of inaccurate information, ask questions about data handling, or submit a privacy-related inquiry. Certain requests may be subject to verification, contractual limitations, service requirements, and applicable law.

Retention of Information

We retain information for as long as reasonably necessary for business, billing, service, security, compliance, dispute resolution, recordkeeping, and enforcement purposes, unless a longer or shorter period is required by law or contract.

Third-Party Services and Websites

Our websites, portals, invoices, and communications may include links to third-party platforms or services. Communications Unlimited Inc. is not responsible for the privacy practices, security controls, or content of third-party websites or providers not under our control.

Policy Updates

Communications Unlimited Inc. may update this Consumer Privacy Disclosure from time to time. Updated versions become effective upon posting or publication through our website or other appropriate customer notice channels.

Communications Unlimited Inc. is an authorized VoIP Services seller for Bandwidth.com & SkySwitch.com.

Communications Unlimited Inc. ("COMMSUNLIMITED") is a nationwide communications and VoIP service provider primarily serving business customers. Many of our customers use our VoIP services in a wholesale manner, offering services of their own together with a Bandwidth telephone number to their end users. In these cases, COMMSUNLIMITED does not have a relationship to the end user or any information about the end user and how the number is being used. In fact, COMMSUNLIMITED may not provide any of the features of the end-user's services even though they may include a COMMSUNLIMITED telephone number.

Communications Unlimited Inc. is registered with E-911 / USAC / FCC in accordance with Florida Telecommunications Laws.

ROUTINE AND HISTORICAL RECORDS REQUESTS

IMPORTANT INFORMATION FOR MEMBERS OF LAW ENFORCEMENT (INCLUDING OTHER PERSONS ACTING IN AN OFFICIAL CAPACITY ON BEHALF OF FEDERAL, STATE, OR LOCAL GOVERNMENTS):

As a courtesy, we offer to verify if target telephone numbers are on the COMMSUNLIMITED network for members of law enforcement without legal process. If a target number is assigned to a wholesale customer of ours, frequently we are able to provide that wholesale customer's legal compliance information without formal legal process. This courtesy is offered to save members of law enforcement the step of first serving Communications Unlimited when in fact such legal process ultimately must be served on our wholesale customer of record in order to obtain any and all end-user information and other records. Our wholesale customer will make its own independent assessment of the request, including, without limitation, any subpoena subsequently delivered.

THEREFORE, PRIOR TO ANY FORMAL LEGAL SERVICE, MEMBERS OF LAW ENFORCEMENT ARE STRONGLY ENCOURAGED TO SEND AN EMAIL WITH THE FOLLOWING INFORMATION TO:

EXIGENT REQUESTS

YOU MUST BE A MEMBER OF LAW ENFORCEMENT WITH A DECLARED VERIFIED EXIGENT SITUATION (exigency as established by your own agency's guidelines).

Send an email to uslawenforcement@commsunlimited.com with the target number and your full law enforcement agency name and contact information, and indicate in the subject line that you have an exigent situation. (All exigent requests must be made in writing via email; we will not provide customer of record information based only on a verbal request.)

We will respond via reply email with customer of record information promptly after assessing the request.

EXIGENT REQUESTS OUTSIDE OF NORMAL BUSINESS HOURS:

Contact Subsection at 1-888-312-3321 (Option 1) and advise Subsection you are inquiring about a number assigned to Communications Unlimited Inc.

Normal Business Hours: Monday – Friday, 9:00 AM to 5:00 PM ET. If during normal business hours you have sent an exigent email and do not get a timely response, please contact Subsection. Subsection will not accept phone calls on any other matters except exigent as described above.

CALEA ORDERS

Send an email to uslawenforcement@commsunlimited.com and attach a copy of your CALEA Order. In each instance, we will assess the request, including, without limitation, any materials delivered, and respond to you accordingly. If you have an exigent CALEA Order please follow the exigent guidelines provided above.
